In deciding whether to grant or refuse approval for a transaction with a non-citizen, the land board shall (a) consider the effect that the grant or refusal of the consent is likely to have on the economic development of the area concerned; (b) take into account any objections made from an interested citizen; (c) act on principle that consent generally ought to be refused where the person to whom the land is to be disposed of is unlikely to use the land well or develop it adequately or already has sufficient land that can he utilised for the purpose he of she proposes to use it; and (d) consider public interest. The salient provisions of the Tribal Land Act and its Regulations are that rights to tribal land ought to be held by way of a Deed of Customary Land Grant.
