Trade Unions has been defined in section 2 of the Trade Unions and Employers’ Organisations Act [Cap 48:01] as an organisation whose principal objects include the regulation of relations between employees and employers or employers' organizations orbetween employees and employees.

An employee has several obligations, these can vary depending on the specific role and the expectations. However, there are some general obligations that most employees have.

As an employer, you have a variety of duties and responsibilities. This section explores some of the key duties of an employer.

The termination of a contract entails the end of a contractual relationship. Termination usually extinguishes the rights and duties that were created by the contract. There are a few ways that an employment contract can be terminated.

The Employment Act [Cap 47:01]was enacted to make provision for the law relating to employment and comprehensive provision for matters incidental thereto.The Act is applicable to all employees and employers in the Republic of Botswana, except the Government of the Republic of Botswana and all of its officers.

The Employment Act [Cap 47:01] defines a contract of employment as an agreement, whether oral or in writing, expressed or implied, whereby one person agrees for a wage or other benefit or both, to let his labour to and to perform it under the orders of another person who agrees to hire i

n terms of section 26 of the Employment Act [Cap 47:01] an employee may be summarily dismissed without the need to give notice or to pay him in lieu thereof where he is guilty of serious misconduct. The employer will however have to exercise this right within a reasonable time of the employer becoming aware of the misconduct.Whether or not a particular act of misconduct is serious enough to warrant summary dismissal is a question of fact in each case.
