Dismissal

n terms of section 26 of the Employment Act [Cap 47:01] an employee may be summarily dismissed without the need to give notice or to pay him in lieu thereof where he is guilty of serious misconduct. The employer will however have to exercise this right within a reasonable time of the employer becoming aware of the misconduct.Whether or not a particular act of misconduct is serious enough to warrant summary dismissal is a question of fact in each case.
