Do you know your rights when giving out your personal information?
Every individual is entitled to have their personal information protected, used in a fair and legal way, and made available to them when they ask for a copy. If an individual feels that their personal information is wrong, they are entitled to ask for that information to be corrected.
Individuals must consent to the use of their personal data.

What is Personal Data?
The Act bars the processing of personal data without the consent of the data subject. This means that any operation or set of operations which is taken in regard to personal data, whether or not it occurs by automatic means cannot be done without the consent of the individual that this data concerns.
A data subject is accorded the right to institute proceedings for damages, within 12 months from the date they became aware orcould have become aware of such contravention, against a data controller who processes data in contravention of the provisions of the Act.
What if your data is located outside Botswana?
The Act applies to the processing of personal data entered in a file by or for a data controller in Botswana; or where the data controller is not in Botswana, by using automated or non- automated means that are situated in Botswana – unless those means are used only to transmit personal data. The transfer of personal data outside Botswana is
expressly barred by the Act, however, the transfer of such data to a third country may only take place if the third country to which the data is being transferred ensures an adequate level of protection of such data and is exempted by the Minister.
